Eligibility: Westgate Resorts #IMOMSOHARD Ladies Night Out Giveaway is open only to those who sign up at the online Giveaway page https://www.instagram.com/westgatevegas/ choosing to “Like” the Giveaway post. Must be twenty-one (21) years of age or older as of the date of entry to be eligible to win. The Giveaway is only open to legal residents of the United States and is void where prohibited by law. Employees of Westgate Resorts, Ltd. (the “Sponsor”), Central Florida Investments, Inc., or its respective affiliates, subsidiaries, advertising and promotion agencies, suppliers, and their immediate family members and/or those living in the same household of each are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited or where not registered. This Giveaway does not discriminate against anyone based on race, sex, age, handicap, religion, national origin, or marital status.
Agreement to Rules: By participating in the Giveaway, you agree to be fully and unconditionally bound by these rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor as final and binding as it relates to the content.
Giveaway Period: Entries will be accepted online at https://www.instagram.com/westgatevegas/ beginning February 13, 2024 (02/13/2024) at 9:00 AM PST and ending February 16, 2024 (02/16/2024) at 5:00 PM PST. All online entries must be received by February 16, 2024 (02/16/2024) at 5:00 PM PST.
How to Enter: The Giveaway must be entered between Tuesday, February 13, 2024 (02/13/2024) starting at 9:00 AM PST through Friday, February 16, 2024 (02/16/2024) by 5:00 PM PST. Just visit the Giveaway page and “Like” the #IMOMSOHARD Ladies Night Out Giveaway post and “Tag” a friend in the comments section. Tagging additional friends in separate comments on the post will result in additional entries into the Giveaway. Share why you’re overdue for a ladies’ night out and receive an additional Giveaway entry. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. Each tag counts as one entry and you must fill in the information requested. You may not use multiple email addresses, accounts, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Sponsor.
Prize and Prize Conditions: One (1) winner will receive four (4) tickets to the #IMOMSOHARD show on March 2, 2024 (03/02/2024) at Westgate Las Vegas Resort & Casino and a $300 meal credit for us at Fresco Italiano before the show. Average retail value is $500. The specifics of the prize shall be solely determined by the Sponsor. Prize must be used on March 2, 2024 (03/02/2024). Must follow reservation directions provided by Sponsor. No cash or other prize substitution permitted except at Sponsor’s sole discretion. The prize is nontransferable. Cannot be combined with any other offer, promotion, or package. If a prize (or part of a prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Winner is responsible for all incidentals, service charges, gratuities, personal expenses, and transportation. Any and all entrants participating in or using profanity, unsportsmanlike conduct, explicit or discriminatory language, and/or defamation of the Westgate brand or any and all others will be automatically disqualified at Sponsor’s sole and absolute discretion. Sponsor shall not be responsible for any lost, garbled, incomplete, and/or corrupted entries, and qualified entries shall be determined in Sponsor’s sole and absolute discretion. Acceptance of prize constitutes permission for Sponsor to use winner’s name, likeness, photograph, statements and biographical information, voice, and address in all forms of media worldwide, in perpetuity, without limitation, notice or further compensation.
Odds: The odds of winning depend on the number of eligible entries received.
Winner selection and notification: The winner of the Giveaway will be selected in a random drawing under the supervision of the Sponsor to be conducted on February 16, 2024 (02/16/2024) at 2801 Old Winter Garden Rd, Ocoee, FL 64761. On February 16, 2024 (02/16/2024) the winner will be notified by public comment via Instagram to the Instagram account they used to enter the Giveaway and via public comment on the Facebook Giveaway post and Facebook Instant Messenger. Winner must claim prize by February 17, 2024 (02/17/2024) by 5:00pm PST by public comment to the winner notification post and by sending a private message to the Sponsor’s Instagram account used to host the Giveaway. Sponsor shall have no liability for a winner’s failure to receive notices due to winners’ lack of account notifications, spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, and/or fails to claim the prize by February 17, 2024 (02/17/2024) by 5:00pm PST, and/or fails to timely return a completed and executed declaration and release as required, prize may be forfeited, and an alternate winner may be selected at Sponsor’s sole and absolute discretion.
The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by you: By entering this content you understand that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
Disputes/Mandatory ARBITRATION: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF USA AND FLORIDA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. In the event of any controversy, claim or dispute between the Entrant and the Sponsor arising out of or relating to the Giveaway or the breach, termination, enforcement, interpretation, conscionability, or validity thereof, including any determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration. Arbitration proceedings shall be administered by the American Arbitration Association (“AAA”) and may take place via the Internet and/or telephonically in accordance with the rules of the chosen arbitration service provider. The arbitrator shall be neutral and independent and shall comply with the AAA code of ethics. The award rendered by the Arbitrator shall be final, binding on all parties, but subject to review in accordance with applicable statutes, rules and regulations governing arbitration awards. Judgment on the award made by the arbitrator may be entered in any court having jurisdiction over the parties. If either party fails to comply with the arbitrator's award, the injured party may petition the circuit court for enforcement. The parties agree that either party may bring claims against the other only in his/her or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, the parties agree that the arbitrator may not consolidate proceedings of more than one person's claims and may not otherwise preside over any form of representative or class proceeding. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator's award, or fails to comply with the arbitrator's award, the other party is entitled to costs of suit, including a reasonable attorney's fee for having to compel arbitration or defend or enforce the award. Binding Arbitration means that both parties give up the right to a trial by a jury. It also means that both parties give up the right to appeal from the arbitrator’s ruling except for a narrow range of issues that can or may be appealed. It also means that discovery may be severely limited by the arbitrator. This section and the arbitration requirement shall survive any termination.
By participating in this Giveaway, the entrant agrees that Sponsor will not be held liable for any actual or potential losses, including without limitations, compensation, or consequential damages, either in contract or in tort, by either person or property, arising out of this Giveaway or in connection therewith or by misrepresentation by a third party. Sponsor is not to be held responsible for any act of God, and/or any other circumstances beyond its control.
You acknowledge and agree that, in any court case you may file, you WAIVE THE RIGHT TO A TRIAL BY JURY AND THAT YOU CANNOT FILE A CLAIM IN A REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL, OR FILE A CLAIM AS A CLASS, COLLECTIVE OR MASS ACTION OR PARTICIPATE IN A CLASS ACTION.
