Eligibility: World of Westgate (“WOW”) Flip.to Giveaway (the “Giveaway”) is open only to those that receive an email or targeted social media post inviting them to enter a vacation photo and story from a recent stay at a Westgate Resort. Must be twenty-one (21) years of age or older as of the date of entry to be eligible to win. The Giveaway is only open to legal residents of the United States and is void where prohibited by law. Employees of Westgate Resorts, Ltd. (the “Sponsor”), Central Florida Investments, Inc., or its respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state and local laws and regulations. Void where prohibited or where not registered. This Giveaway does not discriminate against anyone based on race, sex, age, handicap, religion, national origin or marital status.
Agreement to Rules: By participating in the Giveaway, you agree to be fully and unconditionally bound by these rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor as final and binding as it relates to the content.
By entering this Giveaway and providing your information, you expressly agree to the following terms and conditions: By providing your name, address, telephone, or electronic mail address (collectively my "Contact Information") or otherwise using this Site, you consent to and request for us to contact you to discuss this offer and the services and products we provide. Providing your Contact Information and your use of our Site shall be construed as a business inquiry by you of Central Florida Investments, Inc. and Westgate Resorts, LTD (collectively "Westgate"), even though neither entity may be affiliated with, or responsible for, the content contained on this offer. Westgate is thereby authorized by you to make a return telephone call to you, and you agree that Westgate may contact you using an automated telephone dialing system, prerecorded message, or by electronic mail. You agree to hold Central Florida Investments, Inc., Westgate Resorts, LTD, and their related or affiliated companies harmless and hereby release and indemnify their agents and employees from any and all liability that may arise from providing your Contact Information or accessing any affiliated sites.
Giveaway Period: Entries will be accepted online during the entry period from May 1, 2023 (05/01/2023) at 3:00 p.m. to July 31, 2023 (07/31/2023). All Entries must be received by 11:59 p.m. on 07/31/2023.
How to Enter: The Giveaway can be entered by submitting a recent family photo and vacation experience during a stay at a Westgate Resort. All entries must be submitted by using the emailed link from Sponsor to submit their recent Westgate Resorts stay photos and story. Those that meet the eligibility criteria can enter the Giveaway by clicking on the Sponsor’s emailed link, provide all requested information and submit their photo and story. The entry must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Limit one (1) entry per person. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You may not use multiple entry submissions in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Sponsor.
Prize and Prize Conditions: One (1) First Place winner will receive a prize package good for a One Thousand Dollar ($1,000) gift certificate valid towards a stay at any Westgate Resorts property, one (1) Second Place winner will receive a prize package good for a Five Hundred Dollar ($500) gift certificate valid towards a stay at any Westgate Resorts property, and one (1) Third Place winner will receive a prize package good for a Two Hundred Dollar ($200) gift certificate valid towards a stay at any Westgate Resorts property. Prize will be given via a digital certificate after winner has claimed prize and submitted all requested information. Prize does not cover transportation costs or other incidentals. The specifics of the prize shall be solely determined by the Sponsor. Winner must follow any reservation directions provided with the prize. Entire value of prize must be used towards a single stay and no change will be given for unused portion. Any unused portion will be considered forfeit. No cash or other prize substitution permitted except at Sponsor’s sole discretion. The prize is nontransferable. Cannot be combined with any other offer, promotion, or package. If a prize (or part of a prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the original prize (or that part of the prize) with an alternative prize to the equal monetary value and/or specification, unless to do so would be prohibited by law. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. Winner is responsible for all incidentals, service charges, gratuities, personal expenses, and transportation to and from Prize. Any and all entrants participating in or using profanity, unsportsmanlike conduct, explicit or discriminatory language, and/or defamation of the Westgate brand or any and all others will be automatically disqualified at Sponsor’s sole and absolute discretion. Sponsor shall not be responsible for any lost, garbled, incomplete, and/or corrupted entries, and qualified entries shall be determined in Sponsor’s sole and absolute discretion. Acceptance of prize constitutes permission for Sponsor to use winner’s name, likeness, photograph, statements and biographical information, voice, and address in all forms of media worldwide, in perpetuity, without limitation, notice or further compensation. Prize certificate expires one (1) year after certificate has been issued.
Odds: The odds of winning depend on the number of eligible entries received.
Winner selection and notification: The winner of the Giveaway will be selected in a random drawing under the supervision of the Sponsor to be conducted on August 1, 2023 (08/01/2023) at Westgate Resorts corporate location in Orlando. Winner will be notified on August 5, 2023 (08/05/2023) by phone and email provided on entry form. Sponsor shall have no liability for a winner’s failure to receive notices due to winners’ lack of account notifications, spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, and/or fails to claim the prize within 48 hours from the time award notification was sent/posted, and/or fails to timely return a completed and executed declaration and release as required, prize may be forfeited, and an alternate winner may be selected at Sponsor’s sole and absolute discretion. Certificate will be good for one (1) year from date of issue.
The receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
Terms and Conditions: Prize is not redeemable for cash or other services. Prize may not be used in conjunction with any other offer, promotion, and/or certificate. Dates for certificate use are subject to availability as determined by Sponsor in its sole and absolute discretion. All entrants must be twenty-one (21) years of age or older and a U.S. Resident to win. Sponsor reserves the right to cancel, suspend, and/or modify the Giveaway if any fraud, virus or other technical problem corrupts the administration, security, or proper delay of the Giveaway, as determined by Sponsor in its sole and absolute discretion. Sponsor also reserves the right to eliminate all entrants found to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these rules shall not constitute a waiver of that provision. Void where prohibited by law or not registered. Sponsor shall not be responsible for any lost, garbled, incomplete or corrupted entries, and qualified entries shall be determined solely in the discretion of Sponsor. Sponsor reserves the right to alter Giveaway terms, requirements, prize and rules at its sole discretion.
Release and Limitations of Liability: The winner agrees to release and forever hold harmless Sponsor, its related and affiliated entities and their respective officers, directors, employees, members, affiliates and agents from and against any claim or cause of action whatsoever arising out of participation in the Giveaway or any claims arising from and against all losses, damages, liabilities, claims, actions, proceedings, or judgments arising out of or relating to entrant’s entry or participation or use or misuse of prizes. All entrants agree to release and forever hold harmless Sponsor, its related and affiliated entities and their respective officers, directors, employees, members, affiliates and agents from and against any claim or cause of action whatsoever arising out of any technical or human error which may occur in the processing of submissions in the Giveaway.
Disputes: This offer is void where prohibited by law. All federal, state, and local laws and regulations apply. Except where prohibited, all issues concerning the construction, validity, interpretation and enforceability of these official rules or the rights and obligations of the entrants, winner(s) and Westgate in connection with the Giveaway shall be governed by, and construed in accordance with, the laws of State of Florida, without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than the State of Florida. Any and all disputes arising directly or indirectly out of or in connection with this Giveaway shall be brought exclusively in State or Federal Court in Orange County, FL. The following Giveaway is intended for viewing and participation at the time of entry and shall be construed and evaluated only according to United States law. Offers are not directed to residents in any state and do not constitute an offer in which a registration of the timeshare plan is required but in which registration requirements have not yet been met.
You acknowledge and agree that, in any court case you may file, you WAIVE THE RIGHT TO A TRIAL BY JURY AND THAT YOU CANNOT FILE A CLAIM IN A REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL, OR FILE A CLAIM AS A CLASS, COLLECTIVE OR MASS ACTION OR PARTICIPATE IN A CLASS ACTION.

By participating in this Giveaway, the entrant agrees that Sponsor will not be held liable for any actual or potential losses, including without limitations, compensation or consequential damages, either in contract or in tort, by either person or property, arising out of this Giveaway or in connection therewith or by misrepresentation by a third party. Sponsor is not to be held responsible for any act of God, and/or any other circumstances beyond its control.
Sponsor reserves the right to change these terms and conditions without notice. These terms and conditions are final and cannot be changed or altered by any statement, merchant, or representative of any unauthorized person(s). No other representations, oral or otherwise, are valid in conjunction with this Giveaway.
