Westgate Resorts Bonus Certificate Terms & Conditions

(IMPORTANT: The Terms & Conditions contain a provision requiring mandatory arbitration and jury trial/class action waiver. Please read below)

• The Bonus Certificate entitles the recipient to two (2) nights of accommodations at any of the participating Westgate Resorts* in a room size ranging from a studio to a standard 1-bedroom unit. Subject to availability and restrictions. Accommodations are for two (2) adults twenty-one (21) years and older and up to two (2) children under eighteen (18). Only hotel units are available for use at the Westgate Las Vegas Resort & Casino and only 2-bedroom units are available at the Westgate Palace Resort with the Bonus Certificate.

• The Bonus Certificate covers all applicable fees and taxes. Excluded from the Bonus Certificate are all costs related to transportation and incidentals, including but not limited to in-room movies, telephone calls and meals.

• The Bonus Certificate is not valid for use with Interval International, RCI, Westgate Cruise & Travel or any other Exchange Company.

• The Bonus Certificate must be used within six (6) months from the date of completion of down payment. The Bonus Certificate cannot be renewed, extended, modified, and is non-transferable.

• The Bonus Certificate cannot be combined with any other discounts, offers or promotions.

• The Purchaser's account must be in good standing at the time Bonus Certificate reservation is placed and at the time of scheduled occupancy of the Bonus Certificate. Specifically, the purchaser must be current on all payments due pursuant to the Purchase Agreement, the Purchase Money Mortgage and Timeshare Declaration, including full payment of all initial purchase deposits, current principal and interest payments, maintenance fees and real estate taxes. In the event any of these sums are not paid as agreed, occupancy may be denied at the Developer's sole discretion.

• Failure to arrive on the scheduled date may be subject to a non-refundable cancellation fee. Any changes and/or modifications to the reservation shall be subject to a $100.00 rebooking fee which shall be payable at the time of the new reservation confirmation.

• Allowable occupancy will be based upon the Bonus Certificate program and resort availability, and within the respective weeks listed below**. Westgate Resorts makes no representation as to the availability of any dates, resort, or room type.

‘Westgate Rewards 3 Day/2 Night Stay – Bonus Certificate’ (the “Certificate” or “Bonus Certificate”) must be used within 6 months of the date of completion of the down payment. Blackout dates apply. Offer is subject to availability and inventory and reservations are done on a first come, first served basis. No refunds will be made for no shows and/or early check-outs. Westgate Resorts (the “Developer”) reserves the right to substitute lodging with comparable items of equal or greater value. Must travel with a valid ID and must adhere to the Terms and Conditions herein. Westgate reserves the right to cancel any duplicate and/or conflicting reservation without notice to end user. Average retail value of offer is between $116 - $296 USD. Purchaser is responsible for all taxes, fees, and/or other government and/or airport-imposed charges. End user is responsible for all outstanding charges and fees incurred before, during, or after their stay, including but not limited to gratuities, meals, and/or transportation costs. This offer should not be considered as free travel. Westgate Resorts reserves the right to substitute lodging and/or gifts and/or tickets with comparable items of equal or greater value.

This offer is void where prohibited by law. All federal, state, and local laws and regulations apply. This offer cannot be exchanged for cash and/or monetary consideration, or used in conjunction with any other offer, promotion, or certificate. By accepting this offer, the end user agrees that Westgate Resorts will not be held liable for any actual or potential losses, including without limitations, compensation or consequential damages arising out of this offer or in connection with or by misrepresentation by a third party. HOTEL POLICIES: You must be a minimum of twenty-one (21) years-old to check-in. A valid photo ID, such as a driver's license or passport is required at check-in. Your major credit card will be pre-authorized for a security deposit for any incidentals (varies per hotel). If you do not have a major credit card, some properties will accept a cash deposit. Must follow reservation directions provided by Developer and a reservation must be made prior to arrival at resort. Special requests such as a rollaway bed or cribs are subject to availability and additional fees. Accommodations are based upon availability and provided by Westgate Resorts and affiliated hotels. Holiday travel requires a minimum of a three-night stay. No refunds will be made for early check-outs. Reservation cancellation requests must be called in by the package owner 48 hours before check-in day. This offer will be considered fulfilled without a refund if the Guest(s) fails to check in to their reservation.

PET POLICY: Some of Westgate's destinations are pet friendly. To find out if a specific resort allows pets, please ask your reservationist, or call 1-855-202-8440. Westgate's guests who take advantage of the pet policy will be subject to an additional non-refundable and/or refundable deposit in an amount at the discretion of each resort. Registered service animals are not subject to Westgate's pet policy and are not subject to any security deposit. Guests are responsible for the behavior of their pet and for all personal injuries and/or property damage related to their pet. Westgate, its employees, and its respective affiliates are indemnified and held harmless from all liability and/or damage suffered as a result of guest’s pets.

Disputes/Mandatory ARBITRATION: THIS OFFER IS GOVERNED BY THE LAWS OF USA AND FLORIDA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. Venue for any action arising hereunder shall exclusively lie in Orange County, Florida. In the event of any controversy, claim or dispute between the Entrant and Westgate arising out of or relating to the offer or the breach, termination, enforcement, interpretation, conscionability, or validity thereof, including any determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration. Arbitration proceedings shall be administered by the American Arbitration Association (“AAA”) and may take place via the Internet and/or telephonically in accordance with the rules of the chosen arbitration service provider. The arbitrator shall be neutral and independent and shall comply with the AAA code of ethics. The award rendered by the Arbitrator shall be final, binding on all parties, but subject to review in accordance with applicable statutes, rules and regulations governing arbitration awards. Judgment on the award made by the arbitrator may be entered in any court having jurisdiction over the parties. If either party fails to comply with the arbitrator's award, the injured party may petition the circuit court for enforcement. The parties agree that either party may bring claims against the other only in his/her or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Further, the parties agree that the arbitrator may not consolidate proceedings of more than one person's claims and may not otherwise preside over any form of representative or class proceeding. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator's award, or fails to comply with the arbitrator's award, the other party is entitled to costs of suit, including a reasonable attorney's fee for having to compel arbitration or defend or enforce the award. Binding Arbitration means that both parties give up the right to a trial by a jury. It also means that both parties give up the right to appeal from the arbitrator’s ruling except for a narrow range of issues that can or may be appealed. It also means that discovery may be severely limited by the arbitrator. This section and the arbitration requirement shall survive any termination.

You acknowledge and agree that, in any court case you may file, you WAIVE THE RIGHT TO A TRIAL BY JURY AND THAT YOU CANNOT FILE A CLAIM IN A REPRESENTATIVE CAPACITY OR AS A PRIVATE ATTORNEY GENERAL, OR FILE A CLAIM AS A CLASS, COLLECTIVE OR MASS ACTION OR PARTICIPATE IN A CLASS ACTION.
